1. Definitions
In these Terms and Conditions, the following terms have the meanings below:
- "Fintua" or "we" or "us" means the training provider operating under the name Fintua, registered at No. 9, Jalan Merdeka Raya, Taman Melaka Raya, 75000 Melaka, Malaysia.
- "User" or "you" means any individual who accesses our website, submits an enquiry, or enrols in a course.
- "Services" means the spreadsheet and financial tools training sessions, workshops and programmes offered by Fintua.
- "Course Materials" means templates, reference cards, printed guides, and other resources provided in connection with a course.
- "Agreement" means these Terms and Conditions as may be updated from time to time.
2. Acceptance of Terms
By accessing our website, submitting an enquiry, or enrolling in any Fintua course, you confirm that you have read, understood and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
Our services are intended for individuals aged 18 and over. By proceeding, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law.
3. Services Provided
Fintua provides in-person spreadsheet and financial tools training at our premises in Taman Melaka Raya, Melaka. Our current course offerings are:
- Budget Spreadsheet Starter Workshop (single session)
- Financial Tools Skills Course (four-week programme)
- Complete Spreadsheet & Tools Programme (multi-session, includes post-programme support)
Session dates and availability are subject to scheduling and participant numbers. We reserve the right to adjust, reschedule or cancel sessions if minimum attendance is not met, in which case enrolled participants will be offered an alternative date or a full refund of fees paid.
All sessions are conducted in English at our Melaka training space. Services are available to residents and visitors in Malaysia. We do not currently offer remote or online delivery.
4. Enrolment and Registration
Enrolment is confirmed upon receipt of your full course fee payment and a written confirmation from Fintua. Submitting an enquiry form does not constitute enrolment. We will confirm your place in writing (by email) once payment has been received.
You are responsible for ensuring that the contact details you provide are accurate. Session details, including date, time and any pre-session instructions, will be sent to the email address you provide.
5. User Responsibilities
When attending a Fintua session, you agree to:
- Arrive on time and bring a laptop with Microsoft Excel or Google Sheets installed
- Conduct yourself respectfully towards trainers and other participants
- Not record sessions (audio or video) without prior written permission from Fintua
- Not reproduce or distribute Course Materials for commercial purposes
- Not disrupt the training environment in a way that affects other participants
Fintua reserves the right to remove any participant who behaves in a disruptive or disrespectful manner, without refund.
6. Intellectual Property
All Course Materials — including templates, printed guides, reference cards and session content — are the intellectual property of Fintua. We grant enrolled participants a non-exclusive, non-transferable personal licence to use these materials for their own personal budgeting and financial tracking purposes.
You may not copy, reproduce, distribute, sell or share Course Materials for commercial purposes or redistribute them to individuals who have not enrolled in the relevant course. The website content, design and structure of fintuagr.cyou are also protected by applicable intellectual property laws.
7. Payment Terms
Course fees are stated in Malaysian Ringgit (RM). Payment is due in full before the start of your enrolled session unless otherwise agreed in writing. We accept bank transfer and other payment methods as advised at the time of enrolment.
Cancellation and refunds: If you cancel your enrolment more than seven (7) days before the session date, you are entitled to a full refund. Cancellations made within seven days of the session are not eligible for a refund, but you may transfer your place to another person or a future session of the same course at our discretion. If Fintua cancels a session, a full refund will be issued within 14 business days.
8. Nature of Training — Important Disclaimer
All content provided by Fintua — including session instruction, templates, printed guides, and any post-session group support — constitutes general skills education in the use of spreadsheet tools. It is provided solely for educational and information purposes.
Nothing produced, discussed or communicated by Fintua constitutes financial advice, investment advice, tax advice, legal advice or any other form of regulated professional advice. Participants should consult a licensed professional for advice specific to their personal financial situation.
Fintua makes no representation that any skill or outcome described in our course materials will apply to your specific circumstances. Results depend on individual effort and application.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Fintua's total liability for any claim arising out of or in connection with these Terms or our services shall not exceed the course fee paid by you for the specific session giving rise to the claim.
We shall not be liable for: indirect or consequential losses; loss of data; loss of earnings or opportunity; or any reliance placed on session content as professional advice. This limitation does not exclude liability for death or personal injury caused by our negligence, or for fraud.
Sessions are delivered in a reasonable and competent manner, but we do not warrant that any specific outcome will result from participation.
10. Indemnification
You agree to indemnify and hold harmless Fintua, its trainers and staff from any claims, losses or expenses arising from your breach of these Terms, your misuse of Course Materials, or your conduct during or after a session.
11. Termination
You may withdraw from a course at any time subject to the cancellation and refund terms in Section 7. Fintua may terminate your access to post-session group support if you act in a manner that is disruptive or contrary to these Terms. Sections 6, 8, 9 and 13 of these Terms survive any termination.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of any dispute arising from these Terms or our services, we encourage you to contact us first to seek an informal resolution. If the matter cannot be resolved informally, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Nothing in this clause prevents either party from seeking urgent injunctive relief through the courts where necessary.
13. General Provisions
- Entire agreement: these Terms constitute the entire agreement between you and Fintua regarding the use of our services, superseding any prior understandings
- Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect
- Waiver: failure by Fintua to enforce any provision shall not constitute a waiver of that provision
- Assignment: you may not transfer your rights or obligations under these Terms without our written consent
- Notices: notices from you to Fintua should be sent to [email protected]
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on this page with a revised date. For enrolled participants, changes will take effect at the start of any new session you book after the revised Terms are published. Continued use of our website or services constitutes acceptance of the revised Terms.
